Employee Agreements

The Murphy Law group represents employees who have legal questions regarding their Employment Contracts as well as employees who are subject to Non-Compete, Non-Disclosure and Confidentially Clauses.  The Murphy Law Group represents individuals in Philadelphia and its suburbs, including residents of Bucks, Montgomery, Delaware, Chester, and Lehigh Counties, and individuals residing in New Jersey.

Employment Contracts

The Murphy Law Group provides guidance to employees on employment contract negotiation and provides legal counseling in reviewing and renegotiating employment contracts.  Employment contracts are legal documents and can be very complicated.  Employment contracts establish the terms and conditions pertaining to an employee’s employment with an employer.  It is important that all employees review the terms of an employment contract with an experienced employment attorney before they sign the agreement.

Pennsylvania Law and Non-Compete Agreements

In Pennsylvania, restrictive covenants (i.e., non-compete, confidentiality, non-disclosure clauses) are generally disfavored by courts.  In order for a restrictive covenant to be enforceable, the following conditions must be met:

  • the restrictive covenant must ancillary to an employment relationship between the parties;
  • the restrictive covenant must be supported by adequate consideration;
  • the restrictions imposed by the covenant must be reasonably necessary for the protection of legitimate interests of the employer; AND
  • the restrictions imposed are reasonably limited in duration and geographic extent.

What should I do if I am subject to a Non-Compete Agreement and I Want to Accept a Job with a New Employer?

If you are subject to a non-compete agreement with your current employer and are contemplating accepting a job with a new employer, you should contact an experienced employment attorney immediately in order determine your legal rights and responsibilities.  The Murphy Law Group can review your non-compete agreement and explain to you your rights, determine whether the non-compete agreement is enforceable and answer any all questions you have.
